1. Acceptance of Terms
By accessing or using the SMX Drives website (smxdrives.com) and purchasing our products, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
2. Products & Pricing
All product descriptions, specifications, and pricing are subject to change without notice. Prices are listed in USD and include DDP (Delivered Duty Paid) shipping for international orders unless explicitly stated otherwise. Applicable taxes or customs duties, if any, remain the responsibility of the buyer.
3. Orders & Payment
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. Payment is required at the time of order. All transactions are processed through secure, PCI-compliant payment processors. We do not store your payment card details on our servers.
4. Shipping & Delivery
Orders are dispatched within 5 – 6 business days. Estimated transit time is 5 – 6 business days for USA, UK, EU, Canada, Australia, and GCC destinations. All orders to these regions ship Delivered Duty Paid (DDP) — SMX Drives acts as the Importer of Record, and all customs duties, import taxes, and clearance fees are included in your checkout total. No additional payment will be requested at delivery. Orders to other regions ship Express International; duties may apply at the destination.
5. Returns & Replacements
All sales are final. We do not accept returns or offer refunds. Motor controllers are safety-critical electronic components, and returned units cannot be safely resold. Every controller is bench-tested and calibrated before dispatch. If your product develops a manufacturing defect or fails under normal use during the warranty period, we will repair or replace it free of charge under our Limited Warranty (see Section 6). If your order arrives damaged in transit or incorrect, contact us within 7 days of delivery at support@smxdrives.com and we will arrange a free replacement.
6. Warranty
All SMX Drives products are covered by our 1-year limited warranty from the date of purchase. The warranty covers manufacturing defects in materials and workmanship under normal use. For full warranty details, please refer to our Warranty Policy.
7. Product Usage & Liability
SMX Drives motor controllers are designed for use with compatible electric vehicles within stated voltage (36-92V) and current (500A continuous / 1600A burst) specifications. Installation must be performed by a qualified technician following our Quick Start Guide. Use outside of specified parameters voids the warranty and is at the buyer's own risk.
8. Intellectual Property
All content on this website, including text, images, logos, graphics, firmware, and software, is the property of Three Shul Motors Pvt Ltd and is protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or modification is strictly prohibited.
9. Limitation of Liability
To the maximum extent permitted by law, Three Shul Motors Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our products or services. Our total liability shall not exceed the purchase price of the product in question.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our website after changes constitutes acceptance of the revised terms.
